Maryland Divorce Laws

There are two types of divorce in Maryland: The limited and the absolute divorce. A limited divorce legalizes the parties' separation but does not provide for final division of property or permit remarriage. An absolute divorce ends the marriage, permits remarriage and determines all rights, including property division.

The legal grounds required to grant a limited divorce are different from the grounds required for an absolute divorce.

  • Grounds for a limited divorce include: cruelty of treatment, excessively vicious conduct, desertion, or voluntary separation where there is a mutual agreement between the parties to separate, the parties are living separate and apart without cohabitation, and there is no reasonable expectation of reconciliation.
  • Grounds for an absolute divorce include: cruelty of treatment, excessively vicious conduct, desertion, adultery, conviction of certain crimes, insanity, voluntary separation where the parties have lived separate and apart without cohabitation for twelve months and there is no reasonable expectation of reconciliation, or a two year separation where the parties have lived separate and apart without cohabitation.
